Conditions of participation for the 2025 anniversary competition

Participation in the competition is subject to the following terms and conditions:

1. competition / participation modalities

The organizer of the competition is Binder Optik GmbH (hereinafter Binder Optik) Wolf-Hirth-Straße 37, 71034 Böblingen, registration court: Stuttgart Local Court HRB 741566. It is represented by the managing directors: Consul General Senator E.h. Dr. Helmut Baur, Dipl.-Oec. Dominic Baur.

2. eligibility / deadline for participation

Eligible to participate are persons aged 16 and over who are resident in Germany. Employees of Binder Optik GmbH and their relatives are excluded from taking part in the competition. Each participant may only take part once; multiple entries will result in the participant being excluded. There will be no notification of exclusion.

The participation period begins on 17.04.2025 and ends on 31.10.2025 at 12:00 noon CET (“Promotion Period”).

3. implementation and processing

All eligible participants who register within the participation period at https://www.binder-optik.de/gewinnspiel-jubilaeum/ using the competition form will be entered.

The competition is carried out by drawing lots and is the responsibility of Binder Optik. The winners will be drawn at random.

The winners will be informed by Binder Optik by email within one week of the end of the competition period. If a winner does not respond within 5 working days after notification, the prize claim expires without substitution and the prize can be raffled off by Binder Optik to another participant. The prizes will be sent to the winners by post or can be collected from the head office of Binder Optik GmbH Wolf-Hirth-Straße 37, 71034 Böblingen. Cash payment of the prize is not possible. Once the prize has been sent, the obligations of Binder Optik in relation to the prize distribution are fulfilled. Binder Optik is not responsible for the undeliverability of prizes, for example due to incorrectly specified addresses, insufficient mailbox storage capacity or system settings of the winners’ e-mail services.

Legal recourse is excluded.

Binder Optik will only pay the postage costs incurred by a winner as a result of participating in this competition or receiving the prize. The winner is responsible for paying any taxes on the prize.

Competition agents and competition clubs are excluded from participating in the promotion. The organizer reserves the right to check compliance with the conditions of participation.

4. Violation of the conditions of participation

In the event of a breach of these conditions of participation, Binder Optik reserves the right to exclude persons from the competition. In such cases, prizes may also be subsequently withdrawn and reclaimed. In particular, persons who make use of unauthorized aids or otherwise gain advantages through manipulation (such as entries/entries via entry services) may be excluded. Each participant may only participate on his/her own behalf; participation on behalf of third parties will result in exclusion.

5. premature termination of the competition

Binder Optik reserves the right to cancel or terminate the competition for good cause without prior notice. In particular, Binder Optik will make use of this option if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for factual or legal reasons (e.g. force majeure), the proper conduct of the game cannot be guaranteed.

7. data protection

The participant is informed that the personal data provided during the registration process will be used exclusively in accordance with the provisions of the EU General Data Protection Regulation (Art. 6 para. 1 lit. B) GDPR).

Binder Optik processes, stores and uses this data to inform participants about its company and its products if consent has been given by clicking the box above the privacy policy. Revocation of this consent is possible at any time with effect for the future, as described in the privacy policy.

8. liability

Binder Optik shall be released from all obligations upon delivery of the prize.

Binder Optik is not liable for damages that may arise due to errors, delays or interruptions in the transmission of data, faults in the technical systems and service, the loss or deletion of data, viruses or in any other way when participating in competitions, unless such damages are caused intentionally or through gross negligence by Binder Optik (its bodies, employees or vicarious agents). This exclusion of liability does not apply to injury to life, limb or health.

9. other

These conditions of participation and the entire legal relationship between the participants and Binder Optik are subject exclusively to the law of the Federal Republic of Germany.

Should individual provisions of the Terms of Use be or become invalid, this shall not affect the validity of the remaining Terms of Use.
